Probate Administration Fees

The probate process is overseen by the Superior Court of California and fees are set in Probate Code § 10800. Professional Fiduciary (Personal Representative) fees are calculated based on the gross assets, plus receipts and gains, minus losses.
  • 4% of the first $100,000 of the estate
  • 3% of the next $100,000 of the estate
  • 2% of the next $800,000 of the estate
  • 1% of the next $9,000,000 of the estate
  • 0.5% of the next $15,000,000 of the estate
  • Court discretion for estate larger than $25,000,000

In addition to statutory fees, pursuant to Probate Code §10801, extraordinary fees can be requested for services such as, but not limited to, tax issues, real property sales and litigation. Though fees for extraordinary services are subject to court approval, extraordinary services are charged start at $215.00 per hour.​

  • Trustee of three or more trusts or powers of attorney, or
  • Conservator for two or more individuals, or
  • Executor for two or more probates.
